1.2 Data Collection. We collect personal data voluntarily provided through contact forms, including name, email address, phone number, and project details. We also collect standard web analytics data (IP addresses, browser type, pages visited) through essential cookies.

1.3 Purpose of Processing. Personal data is processed solely for the purpose of responding to inquiries, providing requested services, and maintaining business communications. We do not sell, rent, or share personal data with third parties for marketing purposes.

1.4 Legal Basis. Processing is based on Article 6(1)(b) of the GDPR — performance of a contract or pre-contractual measures — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

1.5 Data Retention. Personal data is retained for the duration necessary to fulfill the purposes for which it was collected, or as required by applicable law. Contact form submissions are retained for a maximum of 24 months.

1.6 Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, and port your personal data. You also have the right to object to processing and to lodge a complaint with the Portuguese supervisory authority (CNPD).

Art. 2

Terms of Service

2.1 Scope. These Terms of Service govern the relationship between ZenvoraPixelWorks ("Provider") and any client ("Client") engaging our web development, design, and consulting services. By engaging our services, the Client agrees to these terms.

2.2 Service Agreement. All services are provided based on a written project proposal or statement of work (SOW) issued by ZenvoraPixelWorks. The SOW defines scope, deliverables, timelines, and pricing. Any modifications require written approval from both parties.

2.3 Payment Terms. Invoices are payable within 14 days of issuance unless otherwise specified in the SOW. A 50% advance payment is required before project commencement for projects exceeding €2,000. Late payments incur a 2% monthly surcharge.

2.4 Intellectual Property. Upon full payment, the Client receives full ownership of all custom deliverables produced under the SOW. ZenvoraPixelWorks retains the right to display completed work in portfolios and case studies unless otherwise agreed.

2.5 Confidentiality. Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the service agreement for a period of 24 months.

2.6 Limitation of Liability. ZenvoraPixelWorks shall not be liable for indirect, incidental, or consequential damages. Total liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim.

2.7 Termination. Either party may terminate the agreement with 14 days written notice. The Client is responsible for payment of all work completed up to the date of termination.

Refund & Reimbursement Policy

4.1 Advance Payments. The 50% advance payment required for projects exceeding €2,000 is refundable if ZenvoraPixelWorks fails to commence work within 14 days of the agreed start date, provided the delay is not caused by the Client.

4.2 Milestone-Based Billing. For projects with milestone-based billing, each milestone payment becomes non-refundable upon approval and delivery of the corresponding deliverable. Approval is assumed if the Client does not raise objections within 5 business days of delivery.

4.3 Completed Work. Fees for completed work are non-refundable. If a project is terminated early by the Client, the Client is liable for payment of all work completed up to the termination date, calculated proportionally based on the project timeline.

4.4 Defective Deliverables. If deliverables do not meet the specifications defined in the SOW, ZenvoraPixelWorks will remedy the defects at no additional cost within a reasonable timeframe. If remedy is not possible, a partial refund proportional to the defective portion will be issued.

4.5 Refund Request Process. Refund requests must be submitted in writing to [email protected] within 30 days of the invoice date. Refunds are processed within 14 business days of approval via the original payment method.

4.6 Non-Refundable Items. Domain registration fees, third-party software licenses, and hosting setup fees are non-refundable once procured on behalf of the Client.
